These Terms are an agreement between you and Workset (Tyson Daffin, sole proprietor), which runs Workset. The canonical version lives at https://getworksetapp.com/terms. Questions: support@getworksetapp.com.
By creating an account or using Workset you agree to these Terms and to our Privacy Policy. Sign-up asks you to agree to them. Agreeing is not consent to health data or AI features: the app asks for each of those separately (Privacy Policy Section 3). If you do not agree, do not use the app.
You must be at least 16 years old to use Workset. Sign-up asks for your birth month and year to check this.
Workset provides fitness and nutrition tracking and AI-generated estimates and suggestions for general informational and wellness purposes only. It is NOT medical advice, NOT a medical device, and NOT a substitute for professional judgment, diagnosis, or treatment. It does not diagnose, treat, cure, or prevent any disease or condition. Consult a qualified professional before starting any exercise or nutrition program, and stop and seek care if you experience pain, dizziness, or other symptoms. AI outputs, including calorie/macro estimates and generated workouts, may be inaccurate; use your judgment. Exercise carries inherent risks; you assume full responsibility for your own health, training, and nutrition decisions and for how you use the app.
You are responsible for the content you post. You agree not to post content that is unlawful, hateful, harassing, sexually explicit, threatening, or that violates others' rights. We use automated and manual moderation and may remove content or suspend accounts that violate these rules.
You can report objectionable posts or comments and block other users from within the app. We aim to review reports promptly and remove violating content and the users responsible. There is zero tolerance for objectionable content or abusive behavior.
You may delete your account at any time from Settings › Account actions › Delete Account. We may suspend or terminate accounts that violate these Terms.
The app is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or that any estimate or insight is accurate.
To the fullest extent permitted by law, Workset (Tyson Daffin, sole proprietor) will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of (or inability to use) the app. To the fullest extent permitted by law, our total liability for any claim relating to the app will not exceed the greater of the amount you paid us for the app in the twelve months before the claim, or US$50. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
You agree to indemnify and hold harmless Workset (Tyson Daffin, sole proprietor) from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the app, or your violation of these Terms.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, except where your local consumer-protection law provides rights that cannot be waived.
Please read this section carefully; it affects how disputes are resolved. Except for small-claims matters and claims for injunctive relief, any dispute arising out of or relating to these Terms or the app will be resolved by binding individual arbitration, and NOT in court, except that you may opt out of arbitration within 30 days of first accepting these Terms by emailing support@getworksetapp.com. You and we waive any right to a jury trial and to participate in a class or representative action. This section does not apply where prohibited by law.
We may update these Terms. When we do, we update the effective date at the top. When a change is material, the app shows you the updated Terms the next time you open it, with a short note of what changed, and asks you to review them and agree before you keep using Workset. We don't count your continued use as agreement to a material change. Until you agree, you can still export your data, log out, or delete your account. A change that isn't material, such as a corrected typo or contact detail, takes effect when we post it.
